These Terms of Service ("Terms") govern your access to and use of The Season mobile application and website at theseasoncoloranalysis.com (together, the "Service"), operated by The Season ("we," "our," or "us").

By downloading the app or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

You must be at least 13 years of age to use the app. By using the app, you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

Our newsletter is delivered through beehiiv, whose platform is not intended for anyone under 18. You must be at least 18 years old to subscribe to our newsletter.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes, subject to these Terms.

To use the AI color analysis, you upload a photo. By doing so, you confirm that:

You keep all rights to your photo. You grant us only the limited permission needed to process it and return your analysis, as described in our Privacy Policy. A copy is stored on your own device so your results continue to display; we do not retain it on our servers.

The Season offers a one-time, non-recurring purchase that unlocks your AI color analysis and personal style guide. This is not a subscription. It does not auto-renew, and you will not be charged again.

All purchases are processed through the Apple App Store or Google Play, depending on where you downloaded the app, and are subject to that store's terms and conditions.

If you reinstall the app or set up a new device, you can restore your previous purchase using the "restore purchase" option, provided you are signed in with the same store account (Apple ID or Google account) used to make the original purchase. Purchases are tied to the store they were made in and cannot be transferred between the App Store and Google Play.

Purchases are handled by Apple or Google. All refund requests must be made directly to the store you purchased from — through your Apple ID account or through Google Play — in accordance with that store's refund policies and applicable law. We are not able to issue refunds directly.

Color season analysis results are provided for informational and styling guidance purposes only.

Results are generated by an AI model based on the photo you submit, and accuracy depends on factors including lighting, image quality, makeup, and hair coloring. Results are an aid to personal styling, not a professional service, and are not a substitute for an in-person color analysis consultation with a trained analyst.

We make no guarantee that your result will match the outcome of an in-person analysis or of another tool.

All content within the Service — including text, graphics, logos, color palette data, imagery, product descriptions, and software — is owned by or licensed to The Season and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content in the Service without our express written permission.

Your personal results card is yours to share on social media or elsewhere.

You may optionally subscribe to our newsletter on our website. By subscribing, you consent to receive emails from us containing seasonal guides, articles, product recommendations, and updates about the Service. Some newsletter content may include affiliate links, as described below.

You can unsubscribe at any time using the link at the bottom of any email. Our newsletter and website are hosted by beehiiv, and your use of them is also subject to beehiiv's applicable terms and privacy policy.

The Service includes product recommendations that link to third-party retailers, including Amazon. Some of these may be affiliate links, meaning we may earn a small commission if you make a purchase — at no additional cost to you.

We do not sell products directly. We are not responsible for the content, pricing, availability, shipping, returns, or practices of third-party retailers. Any purchase you make from a third-party retailer is a transaction between you and that retailer.

Product availability and pricing shown in the app may change or become out of date.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that results will meet your expectations.

To the fullest extent permitted by law, The Season and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages.

Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $10 USD if you have not made any payments.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages, so some of the above may not apply to you.

You agree to indemnify and hold harmless The Season and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights — including any claim arising from a photo you upload.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or are misusing the Service.

You may stop using the Service at any time by deleting the app. Upon termination, your right to use the Service immediately ceases. Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

These Terms are between you and The Season only, not with Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the app. In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

These Terms are governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Ohio.

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by notifying you within the app. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
