These Terms of Service ("Terms") govern your access to and use of The Season mobile application and website at theseasoncoloranalysis.com (together, the "Service"), operated by The Season ("we," "our," or "us").

By downloading the app or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes, subject to these Terms.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately if you suspect unauthorized use of your account.

We reserve the right to terminate accounts that violate these Terms or that have been inactive for an extended period.

The Season offers optional in-app purchases and auto-renewing subscriptions ("Premium") that unlock additional features. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions.

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period — you will retain access to Premium features until then.

All purchases are final and non-refundable except as required by applicable law or Apple's refund policies. If you believe you are entitled to a refund, please contact Apple Support directly.

We may offer free trials of Premium features. At the end of a free trial, your subscription will automatically begin and your Apple ID will be charged unless you cancel before the trial period ends.

All content within the Service — including but not limited to text, graphics, logos, color palette data, product descriptions, and software — is owned by or licensed to The Season and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content in the Service without our express written permission.

The Service may include product recommendations that link to third-party retailers (including Amazon). These links may be affiliate links, meaning we earn a small commission if you make a purchase — at no additional cost to you. We are not responsible for the content, pricing, availability, or practices of third-party websites and retailers.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Color season analysis results are provided for informational and styling guidance purposes only. Results are generated by AI based on the photo you submit and are not a substitute for an in-person professional color analysis consultation.

To the fullest extent permitted by law, The Season and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages.

Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $10 USD if you have not made any payments.

You agree to indemnify and hold harmless The Season and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

Upon termination, your right to use the Service will immediately cease.

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the United States.

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by notifying you within the app. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
